This website is created to seek help for an extreme injustice.

Randy Anderson is a 54 year old man who is currently serving a 58 year sentence for a crime that he did not commit, and the only evidence in the case proves it.

In May of 1995, he was charged with two counts of sexual assault.  Because he was on probation for a 1991 breaking and entering conviction, he was presented as a probation violator.  A violation of probation hearing was held at Kent County Superior Court beginning on June 27, 1995.  During the course of the hearing, the Complainant testified that, prior to the alleged sexual assaults by Randy, she was raped in May of 1994 by her ex-boyfriend, Joseph Theroux,  at his home.  According to her testimony, she informed Randy and her two best friends, Corissa and Bethann, that she had been raped by her ex-boyfriend.  After a week long hearing, the presiding justice, Francis Darigan, found the Complainant’s testimony to be credible and that a violation of probation had occurred.  As a result, the judge imposed all of Randy’s eighteen year suspended sentence for the breaking and entering conviction.

On October 19, 1998, three years and five months after his arrest, Randy’s trial began.  Prior to the start of the trial, Randy’s trial attorney, Mark Smith, filed a motion for the production of discovery and inspection of all favorable evidence in the State’s possession under Rhode Island Superior Court Rule 16(a)(5) and Brady v. Maryland, 373 U.S. 83 (1963). The Assistant Attorney General, Steve Regine, informed the Court that everything in the State’s possession had been turned over to the defense attorney.  Randy’s trial attorney then informed the Court that Randy had an alibi that would testify that, on March 12, 1995, he was home and not out committing a sexual assault as charged by the State.  In addition to the alibi, the defense attorney also filed a Rhode Island Superior Court Criminal Rule 26.3 motion to impeach the credibility of the Complainant because of prior false accusations of sexual abuse.
